1. Agreement to these terms

These Terms & Conditions govern use of this website and requests for computer repair, data recovery, managed IT and related services. By using the website or instructing us to begin work, you confirm that you have read and accepted the terms that apply to the relevant activity.

A written quotation, service order, managed services agreement or other signed document may contain additional or different terms. If there is an inconsistency, the more specific written agreement prevails for that service.

3. Website information

Website content is general information and does not replace a device assessment, security review, quotation or professional advice tailored to a particular system. We take reasonable care with content but do not promise that every description, availability estimate or technical statement is complete or current.

4. Service requests and quotations

An enquiry is not an accepted service order. We may request further information, inspect equipment, confirm authority and issue a quotation or scope before work begins. Quotations are based on the information and visible condition available at the time and may change if hidden faults, additional damage, incompatible parts, security risks or expanded instructions are discovered.

We will seek approval before material work outside an agreed scope unless urgent action is reasonably necessary to protect data, systems or safety and the customer has authorised that category of action.

5. Diagnostics and assessment

Diagnostic work may require opening equipment, running tests, connecting storage media, using specialist tools, starting systems in safe modes or temporarily changing configuration. Existing damage, wear, corrosion, unauthorised modifications or failing components can become more apparent during assessment.

A diagnostic or recovery assessment fee may apply even if repair or recovery is not possible or the customer decides not to proceed.

6. Customer authority and responsibilities

The customer warrants that they own the equipment and data or have lawful authority from the owner to request the service. The customer must provide accurate information, disclose known hazards or encryption, supply necessary credentials lawfully, maintain current contact details and respond to approvals within a reasonable time.

The customer must not ask us to access unlawfully obtained devices, bypass lawful restrictions, infringe intellectual property, conceal evidence or perform any illegal activity.

7. Backups and risk of data loss

Unless the service is specifically data recovery, the customer is responsible for maintaining a current, verified backup before equipment is supplied or remote work begins. Repair, malware removal, updates, storage replacement and configuration changes can involve unavoidable risk of data loss or corruption.

We take reasonable care but do not guarantee preservation of data on unstable, damaged or infected equipment. A customer who cannot make a backup should tell us before work begins so that available options can be discussed.

8. Data recovery services

Data recovery outcomes depend on media condition, prior use, encryption, overwrite, physical damage and other factors. We do not guarantee that any particular file will be recovered, that recovered files will be usable, or that folder structures and metadata will remain intact.

Recovery estimates are based on preliminary assessment and can change after deeper inspection. The customer must inspect delivered data promptly and notify us of apparent issues within the stated collection or verification period.

9. Parts and replacement products

Replacement parts may be new, manufacturer-refurbished or quality-tested compatible products as stated in the quotation. Availability, model revisions and supplier lead times can change. Removed parts will be returned on request where lawful and practical, except exchange components, hazardous items or parts retained under a manufacturer process.

10. Remote and on-site services

Remote support requires a suitable connection and authorised access. The customer should remain available where requested and close unrelated confidential material. On-site work requires safe access to premises, equipment and utilities. Waiting time, parking, travel or after-hours charges may apply where disclosed.

11. Managed IT and cybersecurity

Managed services reduce risk but cannot eliminate outages, attacks, human error or previously unknown vulnerabilities. The customer remains responsible for business decisions, legal compliance, staff conduct, authorised users and implementing recommendations that fall outside the contracted scope.

Security recommendations are based on information available at the time. Threats and vendor products change, so controls require ongoing review.

12. Timelines and availability

Any completion date is an estimate unless expressly guaranteed in writing. Timing can be affected by parts, third-party vendors, specialist laboratories, customer approvals, data volume, hidden faults, public holidays and events beyond reasonable control.

13. Fees, invoices and payment

Fees are stated in Australian dollars unless noted otherwise. The customer must pay approved charges, applicable taxes, parts, freight and disclosed third-party costs by the due date. We may require a deposit, staged payment or full payment before releasing equipment or recovered data.

Overdue amounts may result in suspension, reasonable recovery costs or lawful retention of equipment, subject to consumer and other applicable laws.

14. Cancellations and uncollected equipment

A customer may cancel before completion, but must pay for work performed, ordered parts, non-refundable third-party charges and reasonable restoration or reassembly. Special-order parts may not be returnable.

If equipment or data is not collected after repeated notice, we may charge storage and, after a reasonable period and lawful notice, deal with uncollected goods according to applicable law. Secure disposal may be used where appropriate.

15. Service warranties

Any voluntary workmanship or parts warranty will be described in the service record. It does not cover unrelated faults, misuse, accidental damage, liquid ingress, malware reinfection, unauthorised changes, consumable wear, customer-supplied parts or failure to follow instructions.

Warranty assessment may require return of the equipment and proof of service.

16. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law. Services supplied to consumers come with statutory guarantees, including that they will be provided with due care and skill and be fit for a disclosed purpose where the law requires.

17. Limitation of liability

To the maximum extent permitted by law, liability for loss that is not caused by our breach, that was not reasonably foreseeable, or that results from customer instructions, pre-existing defects, absent backups, third-party products or events beyond reasonable control is excluded.

Where liability may lawfully be limited, our liability may be limited, at our option, to supplying the services again or paying the reasonable cost of having them supplied again. This clause does not limit liability that cannot legally be limited.

18. Business losses

For services acquired for business purposes, the customer is responsible for continuity planning and backups. To the extent permitted by law, we are not liable for indirect or consequential loss, lost profit, lost opportunity, lost revenue, reputational harm or interruption that could reasonably have been avoided through current backups, redundancy or following our written recommendations.

19. Confidentiality and privacy

Each party must protect confidential information received for the service and use it only for the agreed purpose, except where disclosure is authorised or legally required. Personal information is handled under our Privacy Policy.

20. Intellectual property

We retain ownership of our pre-existing tools, templates, methods, documentation and know-how. After payment, the customer may use deliverables created specifically for them for the agreed internal purpose, subject to third-party licence terms. Website content may not be copied or commercially reused without permission except as allowed by law.

21. Acceptable website use

Users must not interfere with the website, attempt unauthorised access, introduce malicious code, scrape at unreasonable volume, impersonate others, submit unlawful material or use the site to infringe rights. We may restrict access to protect the service or other users.

22. Third-party products and services

Hardware, operating systems, cloud services, software and telecommunications supplied by third parties are subject to their own terms, warranties, availability and lifecycle decisions. We are not responsible for a third party's independent acts, but will provide reasonable assistance within the agreed scope.

23. Suspension and termination

We may suspend or end a service where payment is overdue, access is unsafe, instructions are unlawful, cooperation is withheld, security is threatened or continuing would breach law or professional obligations. Accrued payment, confidentiality, intellectual property and liability provisions continue after termination.

24. Disputes and complaints

A party should first provide written details of a dispute and allow a reasonable opportunity to investigate and resolve it. We may propose discussion, technical reassessment, mediation or another proportionate process. Consumer rights to approach a regulator, tribunal or court are not restricted.

25. Governing law

These terms are governed by the laws of New South Wales, Australia. Courts and tribunals with jurisdiction in New South Wales may hear disputes, subject to any mandatory rights to bring proceedings elsewhere.

26. Changes to terms

We may update website terms for future use when services, risks or laws change. The version accepted for an existing service continues unless the parties lawfully agree otherwise or a mandatory change applies.
